FACTS: In this case, petitioner was being dismissed
for uttering insults and offensive words, referring to or directed against
Scheing-Plough Corporations Management Committee.
HELD: “Given the environmental circumstances of this case, the acts of
petitioner clearly do not constitute serious misconduct as to justify
dismissal. Neither is his dismissal justified o the ground of loss of
confidence. As a ground for dismissal, the term “trust and confidence” is
restricted to managerial employees. Petitioner is not a managerial employee.”
